Good appeals don't come cheap.  They take time, preparation, and expertise.  A bad appeal is a waste of money.  A good appeal can make all the difference in the world to you.

Gerald F. Posner has been handling appeals in the state and federal courts ever since graduating Yale Law School in 1974.  Since 2003, he has served as an elected member of the Council of the State Bar of Michigan Appellate Practice Section.

A good appellate brief takes research, careful preparation, clear and concise presentation of the law and facts, and time.  Because of the time it takes to file a proper appellate brief and the cost of the appeal, you need honest advice from your appellate attorney as to whether filing an appeal is reasonable or may be cost-effective for you.  If we do not think that you have any reasonable chance to prevail on appeal, we will tell you that and won't take your money.  If we think that there is a reasonable chance for you to win on appeal, we will advise you, provide you with an estimate of the cost, and work with you to make a financial arrangement or payment schedule.

There are deadlines for filing appeals.  In general, in state court appeals from a decision of the circuit court, an appeal of right must be filed within 21 days of the date the final order is entered.  If that deadline is missed, a delayed application for leave to appeal may be able to be filed.  If you have received an adverse decision in the Court of Appeals in a civil case, an application for leave to appeal to the Michigan Supreme Court must be filed within 42 days of the Court of Appeals decision.
