Our firm represents clients in cases involving:

Under Michigan's wrongful death statute, damages include damages for the loss of financial support, loss of the society and companionship and parental training and guidance of the deceased, as well as compensation for the pain and suffering, while conscious, undergone by the deceased during the period between the time of the injury and death.  The persons entitled to damages include, but are not limited to the deceased's spouse, children, descendants, parents, grandparents, and brothers and sisters.

Many of these cases present challenging legal or medical aspects.  Posner, Posner and Posner has significant and substantial experience in all types of cases involving negligence, serious injury, and wrongful death.

Wrongful Death Distribution Hearing Lawyer

When a wrongful death case is settled, or when there is a judgment, the court must hold a hearing to determine how much of the settlement each person is to receive.  If you are a person entitled to recover damages under the wrongful death statute, you are entitled to notice of the proposed distribution and of the court hearing on that proposal.

We can represent you in a wrongful death distribution hearing.  If you object to the proposed distribution of the proceeds of the wrongful death case, you must present a claim for damages to the personal representative on or before the date set for hearing on the motion for distribution of the proceeds or you will be barred from making a claim to any of the proceeds.  You must then appear at the hearing to present evidence and arguments as to why you are entitled to more of the money than what was proposed.

Posner, Posner and Posner has substantial experience in representing people in wrongful death distribution hearings, and we can guide you through the process, make sure that proper pleadings are filed, and represent you at the hearing.
